To further communication and cooperation between the City and County on water and sewer service and develop a regional water utility, the New Mexico Legislature adopted legislation in 2003 creating the Albuquerque Bernalillo County Water Utility Authority (Authority) and transferred all functions, appropriations, monies, records, equipment and other real and personal property pertaining to the Water/Sewer System to the Authority. The Authority is comprised of a board of three City Councilors, three County Commissioners and the Mayor of the City. Under the provisions of the legislation, the Water/Sewer System was transferred to the Authority on December 2003, after completion of an audit of the Water/Sewer System by New Mexico Public Regulation Commission.
To facilitate the transfer, the City, County and the Authority have entered into a joint powers agreement governing policy matters and a memorandum of understanding governing operational matters. Both of these documents provide a framework for the Authority to operate successfully and without interruption to the services provided to the community. While transfer of the Water/Sewer System to the Authority is not yet complete, it is expected that a phased transfer of operations will be completed by approximately December 31, 2006.
